Case Against DSS for Mishandling CPS Investigation: $1,625,000 Settlement
On June 3, 2022, Carlos Mahoney and Lynne Holtkamp finalized a $1,625,000 global settlement for a minor child in a case against DSS social workers. The case arose from the mishandling of a child protective services investigation into allegations of sexual abuse and neglect. As a result, the child was subjected to further abuse and neglect before she was placed with a foster care family. The settlement was reported in NC Lawyers Weekly on April 18, 2023.

Jury Verdict Against Drunk Driver: $10,755,000 Verdict
On May 26, 2021, Carlos Mahoney obtained a verdict in the total amount of $10,755,000 ($4,255,000 compensatory damages, $6,500,000 punitive damages) from a Craven County jury for injuries suffered by a female motorist in a motor vehicle wreck caused by a drunk driver. Liability was established at summary judgment but damages were contested at trial. The jury verdict was reported in the New Bern Sun Journal on June 3, 2021, NC Lawyers Weekly on July 19, 2021, in the Top Verdicts and Settlements of 2021 (#5) by NC Lawyers Weekly on March 24, 2022, and Top 100 Jury Verdicts (Personal Injury) in 2021 in the United States.

Mom of inmate who died after beating settles suit for $985K:
On July 13, 2020, Carlos Mahoney and Matthew Sullivan from White & Allen in Kinston finalized a $985,000 global settlement in a civil rights case arising from the wrongful death of Graydon Jerome Parker, III, age 54, in the Wayne County Detention Center in Goldsboro, NC.

Mr. Parker was in an acute manic state and experiencing a psychiatric emergency when he was arrested and admitted to the Detention Center. The detention officers and nursing staff did not obtain any medical treatment for him and he was pepper-sprayed, stripped naked, and placed in a segregation cell for nine hours. Mr. Parker’s mental state deteriorated and he was involved during the night-shift in a fatal altercation with five detention officers and a state trooper. He experienced sudden cardiac arrest and later died due to blunt force trauma, pepper spray, multiple taser applications, and positional asphyxia while being held in a prone position.

The wrongful death lawsuit was filed in the U.S. District Court for the Eastern District of North Carolina against fifteen defendants. The claims included deliberate indifference to his serious medical needs and excessive force in violation of Mr. Parker’s due process rights under the 14th amendment. Mr. Parker was survived by his mother.

Man involved in three-vehicle wreck receives $825K in arbitration:
On August 24, 2019, Carlos Mahoney received an $825,000 arbitration award in an underinsured motorist case for a male client who was severely injured at the age of 26 in a three-vehicle wreck in Person County, NC. The arbitration award was more than three times greater than the insurance company’s highest offer. The insurance company contested liability and damages at the arbitration hearing. Following the arbitration award, the client’s workers compensation case was settled for $75,000.

Wilmington man settles civil rights suit against detective for $500K:
On April 13, 2019, Carlos Mahoney successfully negotiated a $500,000 settlement in a civil rights case for a male client in a Fourth Amendment case alleging that he was arrested and prosecuted for various crimes without probable cause. The client was 54 years old at the time of arrest. Local news outlets reported the charges against him and he was terminated from his job.

The lawsuit was filed against a City of Wilmington police detective in the United States District Court for the Eastern District of North Carolina. The case settled at a second mediation after fourteen depositions of fact and expert witnesses were taken.

Personal Injury – $480,000 Settlement
In 2017, William Mills obtained a settlement on behalf of a patient who was injured by the negligence of his dentist.

William Mills recently settled a claim on behalf of a Duke University Student:
William Mills recently settled a claim on behalf of a Duke University Student that had two concussions from separate car collisions 6 months apart. The case was filed against both of the other car drivers in one suit and settled on the verge of trial for a total of $625,000

Carlos Mahoney obtained a verdict from a Northampton County:
On March 19, 2014, Carlos Mahoney obtained a verdict from a Northampton County jury in favor of the firm’s client in an estate dispute. The jury determined that the firm’s client did not willfully abandon the care and maintenance of his deceased son. The jury also determined that the plaintiff had taken clearly inconsistent positions in her handling of the wrongful death claim and that she had pursued the willful abandonment claim in bad faith. The Superior Court entered Judgment on the verdict and allowed the firm’s client to recover ½ of the wrongful death proceeds plus court costs from the plaintiff.

Personal Injury & Wrongful Death – $600,000 Settlement
In January 2014 William S. Mills obtained a settlement on behalf of a motorcyclist killed after a pickup truck pulled out in his path. The case was settled for a total of $600,000. Mr. Mills succeeded in obtaining all of the available liability insurance coverage and then succeeded in stacking three separate underinsured motorists policies, obtaining the limits available under all policies.

Personal Injury & Wrongful Death – $1,000,000 Settlement
In 2013 William S. Mills represented a motorcyclist who suffered a severe fracture to his left femur when a car made a left hand turn into his path. The case was successfully resolved at mediation for $1,000,000.00. The settlement occurred after the motorcyclist had successfully returned to work.

Personal Injury & Wrongful Death – $290,000 Settlement
In August of 2013 William S. Mills was successful in obtaining a total of $290,000 for the driver of a pickup truck that sustained injuries in a collision. The injured driver did not sustain any fractures but developed Complex Regional Pain Syndrome following the collision. The case was settled without the need of a mediated settlement conference.

Civil Rights – $1,000,000 Settlement
On August 27, 2012, a $1,000,000 settlement was finalized in a civil rights action for injuries suffered by a 53-year-old man who was shot with a taser by a deputy sheriff. Details of the case may be found in a Memorandum Opinion at 2012 WL 2239743.

Personal Injury – $200,000 Verdict
On July 13, 2012, a Wake County jury returned a verdict in the amount of $200,000 for personal injuries suffered by a male motorist in a motor vehicle accident. After the assessment of interest and court costs, liability insurer paid $238,191.03.

Personal Injury & Wrongful Death – $725,000 Settlement
In June of 2012 William S. Mills represented an 84 year old gentlemen who was struck by a vehicle in a parking lot. The gentlemen sustained a traumatic brain injury as a result of the collision. The plaintiff had a suffered a similar brain injury five years previously after falling down stairs in his home which required two months of inpatient treatment for cognitive impairments. Supportive treating neurologist was helpful in overcoming the challenges presented by the pre-existing conditions. The case was settled for $725,000. Personal Injury & Wrongful Death – $550,000 Settlement
William S. Mills represented Plaintiff in a medical negligence wrongful death case in which a woman injured in an automobile accident allegedly died as a result of a fentanyl overdose. The case resolved for the sum of $550,000.00 Further details are confidential by agreement of the parties.

Personal Injury & Wrongful Death – $250,000 Settlement
William S. Mills represented a bicyclist injured in Durham, N.C. in May of 2010 and successfully settled the case for the sum of $250,000.

Personal Injury & Wrongful Death – $800,000 Settlement
In 2009 William S. Mills represented the estate of a 73 year old woman killed when struck by a large truck as she was stopped on the side of the road as a result of a license check point. The case was settled for $800,000. Further details are confidential by agreement of the parties.

Civil Rights – $850,000 Verdict
On October 27, 2009, a federal jury returned a verdict in the total amount of $850,000 ($650,000 compensatory damages, $200,000 punitive damages) in a civil rights action for injuries suffered by a 27-year old man in a police shooting by a deputy sheriff. The case was subsequently settled for $1,230,000. The verdict and settlement was reported in NC Lawyers Weekly on December 7, 2009.

Personal Injury & Wrongful Death – $5,500,000 Verdict
On March 6, 2009, a McDowell County jury returned a verdict in the total amount of $5,500,000 for injuries suffered by a female motorist ($2,500,000), injuries suffered by her 6-year old daughter ($1,000,000), and the wrongful death of her 2-year old daughter ($2,000,000) in a motor vehicle accident caused by a deputy sheriff. At trial, liability was admitted but damages were contested. The sheriff’s insurance company filed a separate lawsuit in federal court to determine the amount of insurance coverage that applied to the verdict. The case was then settled for $1,071,875 due to limited insurance coverage and multiple claimants. The verdict was reported in NC Lawyers Weekly on April 13, 2009.

Personal Injury – $1,100,000 Settlement
On December 4, 2008, the City of Raleigh agreed to pay a $1,100,000 settlement for injuries suffered by a female motorist in a motor vehicle accident with the city’s recycling truck. The settlement was reported in NC Lawyers Weekly on December 22, 2008 and in the News & Observer on December 31, 2008.

Civil Rights/Criminal Law
On September 19, 2008, a Durham County Superior Court Judge issued an order granting a motion for appropriate relief on the grounds of ineffective assistance of counsel, newly discovered evidence, and the prosecution’s failure to disclose exculpatory evidence. The charges were dismissed and the client was freed from prison nearly seven years after his convictions at the age of 15. The ruling was reported in The News & Observer on September 20, 2008.

Personal Injury – $375,000 Settlement
On April 27, 2007, the City of Durham agreed to pay a $375,000 settlement for injuries suffered by a female pedestrian in a motor vehicle accident caused by a city police officer. The settlement was reported in The Herald-Sun and News & Observer on May 11, 2007.

Employment Discrimination Law
On June 28, 2004, NC Lawyers Weekly reported that a Durham County judge ordered Durham Technical Community College to pay a former employee $12,012 in back wages plus her legal fees of nearly $100,000 following a finding that the school discriminated against her due to her polio-related disability. The ruling was reported in NC Lawyers Weekly on June 28, 2004.

On February 20, 2004, an Orange County jury returned a verdict in the total amount of $240,995 for injuries ($240,000) and damages ($995) suffered by a male bicyclist in a motor vehicle accident in Hillsborough. The verdict was reported in NC Lawyers Weekly on August 9, 2004.

On October 1, 2003, a $600,000 confidential settlement was obtained for a female tenant who was injured as a result of inadequate security at an apartment. The settlement was reported in NC Lawyers Weekly on November 17, 2003.
