Court of Appeals Upholds Award for Firm Client
On April 3, 2018, the North Carolina Court of Appeals affirmed the final decision and order in favor of Daniel Mullins’s client by Administrative Law Judge Melissa Lassiter. The Court of Appeals issued a published opinion finding that ALJ Lassiter appropriately weighed all the evidence and concluded that Respondent did not have just cause to suspend Petitioner without pay for five days for tardiness. The Court further found that there was substantial evidence to support the ALJ’s decision.
