Federal and North Carolina anti-discrimination laws prohibit an employer from discriminating against a current or prospective employee because of that individual’s race, sex, religion, national origin, pregnancy, age, or disability.

Title VII of the Civil Rights Act: Prohibits discrimination on the basis of race, sex, pregnancy, religion, or national origin.

Age Discrimination in Employment Act (ADEA): Prohibits discrimination against individuals 40 years of age or greater.

Americans with Disabilities Act (ADA): Prohibits disability discrimination.

North Carolina Equal Employment Practices Act: Prohibits discrimination on the basis of race, religion, color, national origin, age, sex, or handicap.

Under these laws, employees are protected from discrimination with respect to all terms and conditions of their employment, including hiring, compensation, promotion, treatment on the job, and termination.

Although much progress has been made in eliminating discrimination from the workplace, not all employers or supervisors in North Carolina follow discrimination laws. It is unlawful for employers to take adverse employment actions based on an employees’ sex, race, age, religion, or ethnic group, or disability. Such actions may include: refusing to hire, denying advancements and promotions, denying equal compensation and benefits, disciplining, demoting, harassing, and firing. It is also unlawful to retaliate against an employee for complaining about what the employee believes to be discrimination.
